🇨🇩 Joseph Kabila Trial Opens in DRC Following Lifting of His Immunity
KINSHASA — July 26, 2025 — Legal proceedings against former Democratic Republic of the Congo President Joseph Kabila have opened following the Senate’s decision to lift his immunity.
Kabila, who served as president of the DRC from 2001 to 2019 and later became a senator for life, faces a series of serious accusations brought by Congolese prosecutors.
The proceedings follow the Senate’s May 22, 2025 decision to lift his immunity, allowing judicial authorities to pursue the case.
Prosecutors Accuse Kabila of Links to M23
Congolese authorities accuse Kabila of complicity with the M23 rebel movement, which Kinshasa says receives military support from neighboring Rwanda.
Rwanda has rejected accusations that it is responsible for the conflict in eastern DRC.
The allegations against Kabila remain accusations to be determined through the judicial process, and he should be considered presumed innocent unless found guilty by a competent court.
Charges Against the Former President
According to the prosecution, the allegations against Kabila include participation in an insurrectional movement, crimes against peace and security, intentional homicide, treason, glorification of crimes, rape and torture, and the deportation of civilians.
The proceedings are also linked by prosecutors to allegations concerning the occupation of Goma and Bukavu by armed forces.
These are extremely serious allegations, and the prosecution will be required to establish Kabila’s individual criminal responsibility before the court.
Justice Ministry: “Justice Does Not Negotiate”
Deputy Minister of Justice and International Litigation Samuel Mbemba Kabuya, who was present at the opening of proceedings, stressed that the judicial process should remain separate from political negotiations.
“Justice does not negotiate, it does not dialogue. The justice calendar is different from the political calendar.”
Prosecutors have taken a firm position that the former president must answer the allegations before the country’s justice system.
A Historic Case for the DRC
The proceedings are politically significant because they involve a former head of state who governed the Democratic Republic of the Congo for nearly two decades.
The case also unfolds against the backdrop of the continuing conflict in eastern DRC and intense political debate over M23, Rwanda and responsibility for the security crisis.
For Congolese authorities, the proceedings represent an effort to establish accountability for alleged crimes connected to the conflict.
For the court, however, the central question will be whether prosecutors can prove the allegations against Kabila with sufficient evidence and in accordance with Congolese law and due-process protections.
